Terms & Conditions Hire Periods & Contract
The full hire period will be agreed during your booking process, followed by your booking confirmation email. The hire contract will become a legal binding document when you accept the delivery of your equipment from Banham Hot Tub Hire.
Your Responsibility
You must assist us with the delivery and collection at your location, in giving us clear instructions, and take all reasonable steps to ensure the safety of our people. We accept no responsibility for any damage or injuries caused. The hirer will supply the water for the equipment in the hire period. You must make sure you have a suitable supply of electricity and it must be in close proximity (within 5m or 14m with our hired extension lead) to where the hot tub will be placed. We require a flat level base to sit the hot tub on, this can be slabs, concrete, blocks or any firm hard standing (we do not set up if the ground is shingle/stones). Some surfaces like raised decking may not be suitable to site a hot tub due to the weight of the full tub plus the people using it, If you do not have adequate standing for our hot tubs, if your not sure then we advise you to contact us before hiring to ensure that your chosen site is suitable. If you plan to use our Hot Tubs on Grassed areas, then you are assuming full responsibility of any damages that may occur as a result. If the area is not level causing the pump not to work, then any requests to refund will not be upheld. The hirer will inspect the hot tub with the Banham Hot Tub Hire representative and note any damage on the equipment. You, the hirer, then become responsible for the hot tub when you receive it – please take extra care to stop any sharp objects from being around or in the Hot Tub and prevent people from jumping in or on the hot tub. We will Empty the water from the tub for you but you will need a drain or suitable disposal area close by to empty the hot tub at the end of the hire period. If you are hiring a gazebo, once this has been erected, the responsibility passes to you, the hirer, to ensure it is free from any damage during your hire period. Banham Hot Tub Hire reserve the right to cancel gazebo bookings up to the time of delivery with a full explanation. If strong winds are forecast during your hire, but not during the setup, this will then be up to you, the hirer, to ensure it is taken down, if necessary, to avoid damage. If, in the unlikely event that damage is caused whilst under your responsibility, you will be liable to pay for the cost of repair or replace, which ever is deemed appropriate by Banham Hot Tub Hire, following their inspection.
Insurance Damage
Whilst Banham Hot Tub Hire are fully covered for business insurance purposes, this does not cover you the hirer for accidental damages, as this is the responsibility of the hirer to obtain insurance for loss and/or damage of equipment. Any damage(s) to our hot tub and/or equipment during the time you, the hirer, have possession of such items, a Banham Hot Tub Hire representative will inspect the damage upon collection. Following the inspection, the representative will confirm what the costs associated with the repair or replace of such items in writing. The cost for replacement of our equipment are detailed below. Replacement items (due to puncture, misuse, undue care or any other reason that would stop any items from being usable): Hot Tub Liner: £150 Inflatable Lid: £50 Hot Tub Pump: £200 Head/neck rest: £10 Filter Housing: £10 Gazebo- frame: £120, side panel £30, canopy (top) £60 Lights: £40 Extension lead: £50 Jenga: £60 Connect 4: £80
Accidents / Injury
The hirer acknowledges that the use of the hot tub is at the hirers own risk Banham Hot Tub Hire will not be held liable for any accidents, injuries or death(s). Banham Hot Tub Hire will not be liable for accidents, injuries, or death(s) caused by misuse of our tubs – this includes falling over on wet surfaces or falling in or out of the hot tub, use of drink, drugs etc. Pregnant ladies must not use the hot tub or seek doctors advise first. Anyone on medication must consult their doctor and if you have any health concerns, please consult your doctor before hot tub use. Children under the age of 16 are strictly prohibited from using the hot tub, unless under strict supervision from adults at all times.
Safety Instructions
You must make sure that everyone using the hot tub is properly instructed on how to use it safely, correctly and that they have all read the instructions we have supplied. Enter the water with care making sure it is not too hot (test first). At a temperature of 37C or above you should not spend more than 15 minutes in the hot tub. You, the hirer, must make sure the hot tub is not misused. Only use plastic glasses in the hot tub. Do not: enter the hot tub with clothes on, suitable swimming attire only. enter the hot tub with shoes on or with any sharp object on your person. dive or jump into the hot tub. sit on the hot tub cover. smoke whilst in or around the Hot Tub. stand on the hot tub housing. use any drugs whilst in or around the Hot Tub. You, the hirer, must ensure everyone using the hot tub is in a sound, healthy and fit state or have permission from their doctor where appropriate to use the hot tub safely. You, the hirer, must make sure users are not under the influence of drugs and/or alcohol. You must ensure that rules over too many people using the Hot Tub at once are put in place to prevent damage to the Hot Tub. You must ensure the cover is on when not in use. Always leave the hot tub plugged in and switched on when not in use, in order for the filtration / heating systems to work. If it is accidentally switched off or a power failure occurs, the tub will need to be switched back on and reset as shown in the setup demonstration. You must make sure everyone showers before using the hot tub.
Use of Chemicals
Your health and wellbeing is of the utmost importance to us. Our hot tubs are; thoroughly cleaned at our base before each new hire period we use detergent and bacteria killer specifically made for hot tubs – if you would like us to clean the hot tub in your presence, please ask us. We bring enough chemicals with us for your hire period and we will show you how to use them. Although we add chemicals, we only use a guidance amount of chlorine for health and safety which may not be enough on its own. It is the hirers responsibility when hiring the Hot Tub to seek guidance over effective third-party chemical usage if needed. To ensure the water in the hot tub is always clean and ready for use during your hire period you must ensure everyone SHOWERS before using the hot tub and all traces of dirt, make up, moisturiser, creams etc must be cleaned from your body before use. The water in the hot tub will be clean when we leave, it is up to you to keep it that way. The only way the water can get dirty, is if you put it there. Do not add bubble bath, foam bath or washing up liquid of any description. DO NOT use the hot tub if the water is not clean, sparkling and smelling fresh. Anyone with fake tan of any description must not use the hot tub. A cleaning charge of £25 may apply if, when Banham Hot Tub Hire inspects the hot tub on collection, if it is heavily soiled or we are dissatisfied with the cleanliness.
Damages to your property
Banham Hot Tub Hire will not be held responsible for any damages to your property through hiring any of our Hot Tubs: this includes any water damage or weight damage to structures, fixtures, fittings, garden or grass areas as a result of the hot tub location. It is the hirers full responsibility to make sure the area where the hot tub is going to be placed is suitable and will not cause any damage. Things like the filled weight of the tub (1325 litres = 300 gal of water) on the surface needs to be considered as well as the amount of water that will be displaced on the floor. We do not recommend hot tubs go indoors.
Limits of our liability
All the times and dates we quote for delivery or collecting the goods are approximate, we will not be liable for any delays caused by circumstances beyond our reasonable control. If the hot tub breaks down or stops working, we will determine the problem as soon as possible after you have reported it to us, and then try to repair or replace it as soon as possible. We will not be responsible for any damage caused to your property or persons. Lost, stolen, damaged or unclean hired hot tub – You, the hirer, are responsible for looking after the hot tub and returning it to us in the same condition and good working order as they were received by you, the hirer. You must pay to us the cost of replacing any hot tub which is lost, stolen, or damaged beyond any economical repair. You should insure the hot tub for the replacement cost. If you do not willingly pay for any damaged replacement part or stolen hot tub, we will pursue a claim in the small claims court.
Our Right of Access
We may enter any land or premises where we reasonably believe the hot tub to be, on the agreed date and time of collection at the end of the agreed hire period.
Refund & Cancellations Policy
Any requests for refunds to be made must be done so in writing via email to: banhamhottubhire@gmail.com giving full details of why a refund is being requested, how much and the original payment method and amount paid. We will then look at such requests and aim to respond within 5-7 working days. Any agreed refunds will be paid either in part or in full to the original card or bank that was used to make the payment for hire. No refund will be given for misuse of property, improper use of guidelines or the absence of a complimentary item. Any lost days during hire by either fault of the equipment or due to delivery shall be compensated by an extension of hire. We will reserve the right not to make any refunds unless a collection and inspection of our equipment has been made first to determine who is at fault. Upon this inspection we will correspond with the hirer within 48 hours of collection and allow the hirer sufficient time to contest our decision. Refunds shall not include a reimbursement of delivery charges where the hirer has used the Hot Tub. No refunds shall be given where a fault has been reported late and led to Banham Hot Tub Hire not being able to provide a remedy for the hirer to continue hire. This also includes where the hirer is not present during installation and the fault is unknown as well as the hirer not seeking advice on proper heating instructions. You can cancel your hot tub hire booking up to 72 hours before the delivery date and your payment will be refunded in full, or you can amend the date of hire. All deposits received are non-refundable. Rescheduling of your hire date if free of charge, with the limit to 1 change per customer, at which point, Banham Hot Tub Hire have the right to cancel your booking.
Other Terms
If any term in this contract cannot be enforced or agreed to, then the hire of Banham Hot Tub Hire equipment will not be supplied. By hiring our hot tubs/equipment you the hirer agree to release Banham Hot Tub Hire and any of its employees from any and all liabilities incurred during the hire or use of the hot tub. On hiring the hot tub, you agree to accept our Term and Conditions and acknowledge that the use of the hot tub is at your own risk, as the hirer.
